1. Introduction

These Terms & Conditions (“Terms”) constitute a binding legal agreement between you (“Client”, “you”, or “your”) and Devs27 (“Devs27”, “we”, “our”, or “us”) governing the use of all AI Voice Agent, call handling, and automation solutions provided by Devs27 (“Services”). By subscribing to or using the Services, you agree to be bound by these Terms.

2. Services Provided

Devs27 provides managed AI Voice Agent services for businesses, including inbound call handling, lead qualification, appointment booking, message handling, and automated SMS/email follow-ups. Clients receive results, reports, and summaries; access to backend software, systems, or infrastructure is not provided unless explicitly agreed in writing. Devs27 may use proprietary or third-party telephony and AI infrastructure providers under confidentiality and data-processing agreements.

3. Pricing, Usage and Payments

  • Trial: Free for 14 days, then $97/month.
  • Usage Rate: approximately $1.00 (USD) per minute of AI call handling.

  • Guarantee: One booked job in your first month or we’ll personally review and make it right.
  • Price: $197 setup, then $397/month recurring.

Minute Rounding: All call durations are rounded up to the next full minute for billing purposes. For example, a call lasting 3 minutes and 2 seconds will be billed as 4 minutes.

Payments: Payments are processed securely through online payment gateways and require a valid debit or credit card. Subscriptions renew automatically unless cancelled before renewal. Clients are responsible for maintaining valid payment details.

4. Refunds

Refunds are not guaranteed. Any request for refund will be reviewed in good faith by Devs27 and may be approved or declined at our sole discretion based on the circumstances. All discussions must occur in writing before any refund is considered.

5. Client Responsibilities

  • Provide accurate business information, service descriptions, and scheduling availability.
  • Maintain an active and connected calendar to enable appointment booking.
  • Ensure all phone numbers, emails, and integrations provided remain active and accessible.
  • Comply with all applicable laws and regulations concerning data protection, call recording, and customer communication, including but not limited to UK GDPR, the U.S. Telephone Consumer Protection Act (TCPA), and state-level recording laws.
  • Ensure that all data, contact lists, or information supplied to Devs27 for AI configuration or training are accurate, lawful, and compliant with relevant privacy requirements.

6. Performance, Fair Use & Service Limitations

While Devs27 strives to maintain high reliability, uninterrupted service and specific call outcomes cannot be guaranteed. “Unlimited” or high-volume usage is subject to reasonable fair use to ensure system stability. We reserve the right to review, limit, or adjust accounts showing unusually high or excessive usage inconsistent with normal business operation.

7. Acceptable Use

Clients shall not use the Services for spam, unsolicited marketing, fraudulent, abusive, or illegal purposes. Violations may result in immediate suspension or termination without refund. Clients are solely responsible for ensuring all communications initiated through the Service comply with applicable laws.

8. Call Recording, Transcripts & Consent

AI calls may generate text transcripts for quality assurance, reporting, and analysis. Optional audio recording may also be enabled upon client request. Transcripts are retained while the AI Voice Agent remains active and are permanently deleted upon account termination. Audio recordings, if enabled, are deleted after a short retention period. Clients are responsible for obtaining any legally required consent from callers and ensuring compliance with all call-recording and wiretap laws in their jurisdiction.

9. AI Behaviour & Limitations

The AI Voice Agent operates using configured workflows, prompts, and data supplied by the client. While designed for accuracy, AI responses may contain errors or omissions due to speech recognition limitations, caller accents, background noise, or ambiguous inputs. Devs27 provides the Service “as-is” and disclaims all responsibility for any miscommunication, missed booking, or lost opportunity arising from AI interactions. Clients are advised to review call summaries regularly.

10. Data Ownership and Processing

Devs27 retains ownership of all Service infrastructure, telephone numbers, AI logic, transcripts, and system data. Clients retain ownership of their customer data and business information. Devs27 acts as a data processor for caller information collected during calls and as a data controller for its own operational data. All processing is carried out in compliance with UK GDPR and relevant international privacy laws.

11. Confidentiality

Both parties agree to maintain the confidentiality of non-public information obtained during the engagement, including technical processes, scripts, workflows, and customer data. This obligation survives termination of the Service. Clients may not publicly reference Devs27, its systems, or partners without written consent.

12. Payments, Defaults & Collections

If payment fails or remains overdue for more than seven (7) days, Devs27 may suspend Services until payment is received. Balances overdue by more than thirty (30) days may be referred to collections. The client shall bear all recovery and legal costs arising from such default.

13. Indemnification

The client agrees to indemnify and hold harmless Devs27, its officers, employees, and affiliates against any loss, claim, liability, or expense (including legal fees) arising out of the client’s misuse of the Services, breach of these Terms, violation of law, or provision of unlawful or inaccurate data to Devs27.

14. Limitation of Liability

In no event shall Devs27 be liable for any indirect, incidental, consequential, or special damages, including lost profits, data, or opportunities. The total aggregate liability of Devs27 for any claim arising out of or relating to the Services shall not exceed the total fees paid by the client in the preceding three (3) months, except in cases of gross negligence or wilful misconduct.

15. Service Updates, Maintenance & Availability

Devs27 may update, modify, or temporarily suspend Services for maintenance or enhancement. While advance notice will be provided where practicable, emergency maintenance may occur without notice. Devs27 aims to maintain 99% uptime, excluding provider or telecom outages beyond its control.

16. Termination & Cancellation

  • Clients may cancel their subscription at any time prior to renewal to avoid additional charges.
  • Devs27 may suspend or terminate Services for misuse, breach of Terms, or non-payment.
  • Upon termination, all Devs27-provisioned numbers, scripts, and automations are deactivated. Transcripts and client data are deleted within thirty (30) days.

17. Amendments

Devs27 reserves the right to amend these Terms at any time. Material changes will be communicated via email or website notice. Continued use of the Service after updates constitutes acceptance of the revised Terms.

18. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. The parties agree that the courts of England and Wales shall have exclusive jurisdiction over any dispute arising under or in connection with these Terms.

19. U.S. Client Addendum

For Clients operating in the United States:

  • Devs27 is responsible for the lawful operation of its own AI systems, infrastructure, and telephony platform.
  • Clients are solely responsible for ensuring that all customer contact information, leads, and data provided to Devs27 were collected in full compliance with applicable federal and state privacy, telemarketing, and call-recording laws, including the TCPA, CCPA/CPRA, and relevant “two-party consent” statutes.
  • Clients are also responsible for ensuring that any data, prompts, or scripts supplied to Devs27 for AI configuration are accurate, lawful, and non-infringing.
  • Devs27 accepts no liability for any unlawful or non-compliant use of the Service by the Client or for data obtained or used without proper consent.
